      </CODE><CODE>Short title. </CODE><CODE>This Act may be cited as =

Act.</CODE><BR>&nbsp;</TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>Section =

      </CODE><CODE>Definitions. </CODE><CODE>As used in this Act, unless =
the=20
      </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>context otherwise requires:</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(a) =
"Agent" means=20
      a licensed real estate "broker" or </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>"salesperson", as those terms are defined in =
Section=20
      1-10 of </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>the Real Estate License Act of 2000, acting on =
behalf=20
      of a </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>seller or buyer of residential real=20
  property.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(b) =
"Buyer" means=20
      any individual, partnership, </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>corporation, or trustee entering into an =
agreement to=20
      purchase </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>any estate or interest in real =
property.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(c) =
"Final=20
      settlement" means the time at which the parties </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>have signed and delivered all papers and =
consideration=20
      to </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>convey title to the estate or interest in the=20
      residential real </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>property being conveyed.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(d) =
"IEMA" means=20
      the Illinois Emergency Management Agency </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Division of Nuclear Safety.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(e) =
"Mitigation"=20
      means measures designed to permanently </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>reduce indoor radon concentrations according =
to=20
      procedures </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>described in 32 Illinois Administrative Code =
Part=20
      422.</CODE></TD></TR></TBODY></TABLE>

    <TD class=3DlineNum colSpan=3D3></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(f) =
"Radon=20
      hazard" means exposure to indoor radon </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>concentrations at or in excess of the United =
States=20
      </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Environmental Protection Agency's, or IEMA's=20
      recommended Radon </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Action Level.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(g) =
"Radon test"=20
      means a measurement of indoor radon </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>concentrations in accordance with 32 Illinois=20
      Administrative </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Code Part 422 for performing radon =
measurements within=20
      the </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>context of a residential real property=20
      transaction.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(h) =
"Residential=20
      real property" means any estate or </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>interest in a manufactured housing lot or a =
parcel of=20
      real </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>property, improved with not less than one nor =
more=20
      than 4 </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>residential dwelling units.</CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(i) =
"Seller"=20
      means any individual, partnership, </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>corporation, or trustee transferring =
residential real=20
      property </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>in return for =
consideration.</CODE><BR>&nbsp;</TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>Section =
10.=20
      </CODE><CODE>Radon testing and disclosure. </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>(a) =
Except as=20
      excluded by Section 20 of this Act, the </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>seller shall provide to the buyer of any =
interest in=20
      </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>residential real property the IEMA pamphlet =
entitled=20
      "Radon </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Testing Guidelines for Real Estate =
Transactions" (or=20
      an </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>equivalent pamphlet approved for use by IEMA) =
and the=20
      Illinois </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Disclosure of Information on Radon Hazards, =
which is=20
      set forth </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>in subsection (b) of this Section, stating =
that the=20
      property </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>may present the potential for exposure to =
radon before=20
      the </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>buyer is obligated under any contract to =
purchase=20
      residential </CODE></TD></TR></TBODY></TABLE>

  <TBODY>
  <TR>
    <TD class=3DlineNum colSpan=3D3></TD></TR>
  <TR>

      of </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>residential real property as required by this=20
      Section:</CODE><BR>&nbsp;</TD></TR>
  <TR>
    <TD class=3Dxsl>
      <CENTER><CODE>DISCLOSURE OF INFORMATION ON RADON=20
  HAZARDS</CODE></CENTER></TD></TR>
  <TR>
    <TD class=3Dxsl>
      <CENTER><CODE>(For Residential Real Property Sales or=20
      Purchases)</CODE></CENTER><BR>&nbsp;</TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>Radon Warning =
Statement</CODE><BR>&nbsp;</TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>&nbsp;&nbsp;&nbsp;&nbsp;</CODE><CODE>Every =
buyer of=20
      any interest in residential real property is </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>notified that the property may present =
exposure to=20
      dangerous </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>levels of indoor radon gas that may place the=20
      occupants at risk </CODE></TD></TR>
  <TR>
    <TD class=3Dxsl><CODE>of developing radon-induced lung cancer. =
Radon, a=20
